What to do if Your Workers Comp Claim is Denied or Terminated

If you are injured and unable to work, chances are you are entirely dependent on workers compensation. If your claim is denied or terminated for some reason, the effects can be devastating. If you are not familiar with the process, it can be extremely difficult to navigate.

The insurance company and your employer can either admit or deny your claim once you file it. There is a statute of limitations on how long you can file a claim after your injury, so you should not hesitate to file it. If your claim is denied initially, that does not mean you are not entitled to benefits. The insurance company will assign its own insurance adjuster, its lawyer and its nurse case manager to review the claim.

Sometimes the reason your claim was denied is simple, like forgetting an aspect of your paperwork. Your first step should be the in-house appeal. You may not have much time for this appeal, as little as a month.
