OHIO WORKERS’ COMP ATTORNEYS EXPLAIN THE LAW

All workers in Ohio have the option of applying for workers compensation benefits when they are hurt on the job. Under the workers compensation law, these benefits pay for the medical treatments that workers need after suffering serious harm. Although it may seem easy to understand these laws, our Ohio workers compensation attorneys want to provide a more thorough explanation of the rights and benefits Ohio workers have.

OHIO WORKERS' COMPENSATION LAWS

According to the Ohio Bureau of Workers’ Compensation (OBWC) in their 2017 annual report, almost 12,000 workers’ compensation claims were disallowed or dismissed. OBWC can and does deny claims. And that is just one way in which you might lose your workers’ compensation rights, and where an experienced, knowledgeable Ohio workers’ comp lawyer can be your greatest asset to restore your rights.

Though employee health and safety should be the first concern, for some employers it is not. And some occupations are just plain dangerous, no matter how diligent the employer and employee. In addition, employers may be interested in minimizing their insurance premiums, which can mean limiting payouts. If you have been injured at work, be sure your rights are protected. Hiring an experienced Ohio workers’ comp attorney is the smart and safe plan to be sure you have representation, someone fighting for your interests, and taking a strategic approach to your compensation needs and employment future.

Another danger once you enter the workers’ comp arena is not receiving adequate compensation or reimbursement for your injuries and potential life-altering damages. As experienced and qualified Ohio workers’ comp lawyers, the attorneys at Larrimer & Larrimer can help you no matter what the difficulty you’re experiencing in your workers’ comp claim – whether it be filing the claim, preparing for a hearing, appealing a denied claim, or ensuring adequate compensation. Workers’ compensation is an important right you have as an employee. Be sure those rights are respected and protected by our family of Ohio workers’ compensation attorneys.

One component of the workers’ compensation laws includes time limits for filing your claims. Be sure you don’t lose out by waiting too long to file your Ohio worker’s comp claim. The workers’ comp insurance can be a lifeline if you have been injured on the job or have lingering effects due to on-the-job injury or exposure. Don’t lose this benefit by waiting too long to file the claim. And don’t be intimidated by complicated claim forms or even fear of retaliation from an employer for asking for what is rightly yours.

OTHER BENEFIT OPTIONS

In addition to TTD and WL benefits, there are several other potential sources of compensation. These include:

  • Permanent Partial Disability (PPD)

benefits that pay for permanent disabilities affecting a specific body part like a leg, arm, eye or finger. PPD pays for lost wages equal to one-third of the employee’s average weekly wage for up to 200 weeks.

  • Permanent Total Disability (PTD)

benefits compensate an employee who is never able to return to work. The payment rate is the same as for TTD, and benefits last for the employee’s life.

  • Living Maintenance (LM)

payments last up to six months to help an employee undergoing vocational rehabilitation.

It can be difficult to know what workers compensation benefits to apply for, not to mention the complexity of the application process and making sure that you have the required documentation. An experienced attorney can assist you with the application process. Our attorneys understand the unique Ohio workers compensation laws and can help prevent a denial of your benefits.
