Points to Keep In Mind About Workers Compensation

Workers compensation laws vary from state to state and often times it is hard to keep all the facts straight. Most companies are required by law to participate in the workers compensation program. The only state that does not require it is Texas. A few things to keep in mind about the system:

  1. You may not be able to sue. One of the reasons the system is in place is to keep employees from bankrupting the employers. However, if the company is negligent or a third party is involved, lawsuits for additional compensation can be filed.

  2. If you are collecting workers compensation your company may be able to offer your job back or another job you are capable of performing. You may be required to accept or risk losing your benefits.

  3. Your employee reserves the right to fight or dispute your claim.

  4. Most injured workers are back to their job within a few weeks.
